Mediation Costs and Fees
Article 1: Definition of Costs
The term “Costs” includes;
- Administrative fees, both the filing fee to be determined in accordance with Article 2 of this Appendix, and the final fee to be determined in accordance with Article 3 of this Appendix;
- Mediator fee, to be determined in accordance with Article 4 of this Appendix;
- The reasonable travel and other expenses incurred by the mediator and/or the SCCA.
Article 2: Filing Fee
Each Request for Mediation pursuant to these Rules must be accompanied by a filing fee of 1,000 SAR. The filing fee is non-refundable.
Article 3: Final Fee
- The SCCA mediation final fee shall be equal to 20% of the arbitration administrative final fee indicated in the Appendix to SCCA Arbitration Rules but it shall normally not exceed 60,000 SAR.
- In exceptional circumstances, the Administrator, at its discretion, may deviate from the rates set out above taking into account all the circumstances of the case, including the amount in dispute.
Article 4: Mediator Fee and Expenses
- The SCCA mediator fee shall be equal to 20% of the one arbitrator Tribunal fee indicated in the Appendix to SCCA Arbitration Rules. Alternatively, the parties and the mediator may agree upon an hourly or per diem mediator fee.
- In exceptional circumstances, the Administrator, at its discretion, may deviate from the rates set out above, based upon a request of a party or the mediator. The Administrator will take into account all the circumstances of the case, including the amount in dispute, its complexity, the amount of work required of the mediator and any other relevant circumstances. Prior to adjusting the fee, the Administrator shall invite observations from all parties and the mediator.
- The amount of reasonable expenses of the mediator shall be fixed by the Administrator.
Article 5: Prior and Subsequent SCCA Arbitration
- When a SCCA mediation is preceded by the submission of a request for arbitration pursuant to the SCCA arbitration Rules concerning the same dispute, there will be no filing fee for the mediation.
- When a SCCA arbitration is preceded by a request for mediation, pursuant to the SCCA mediation Rules concerning the same dispute, the filing fee paid for mediation shall be credited to the arbitration administrative fee.
Article 6: Methods of Payment
- All amounts due and owing in relation to the mediation costs shall be deposited with the SCCA and shall remain there until the termination of mediation. Amounts paid as advances on Costs do not yield interest for the parties, the mediator or the SCCA.
- The payment of the Costs shall not engage any charges on the SCCA.
